Broadcaster to appeal COC cancellation

Broadcaster and Councilorable John Susi will file a Motion for Consideration following the decision of the COMELEC to cancel his Certificate of Candidacy (COC).

On Wednesday, March 9, the COMELEC First Division canceled Susi’s COC for Councilor of the City of San Fernando due to “material misrepresentation.”

The Resolution, which was promulgated on March 8, read: “The Certificate of Candidacy of Respondent Jun John Susi for the position of Member, Sangguniang Panglungsod of the City of San Fernando, Pampanga is hereby CANCELLED.”

The Resolution also stated that Susi “deliberately misled the electorate as to his qualifications for the office he seeks to be elected when he misrepresented a material fact in his COC.”

Susi, who is currently serving his third and last term as Councilor of Lubao, indicated “City of San Fernando” as his address.

Further, the Resolution stated “material misrepresentation in a COC is an election offense under Section 262, in relation to Section 74 of the OEC (Omnibus Election Code).”

Meanwhile, Susi said that “The decision is not final. I will file a motion for reconsideration. The First Division did not consider all our evidence, which would clearly show that I am a resident of San Fernando.”

Susi revealed that he will file the Motion for Reconsideration this coming Monday, March 14.
