COMELEC REMINDS: LOSING CANDIDATES BARRED FROM GOVERNMENT POSTS FOR ONE YEAR

The Commission on Elections (Comelec) reiterated on Thursday that individuals who lost in the recent elections are barred from being appointed to any government position within one year after the polls.

“The one-year ban is effective. A losing candidate in an election cannot be appointed to the government. Therefore, one must wait for one year (to be appointed),” said Comelec Chairperson George Garcia in an interview.

Garcia emphasized that the restriction is a mandatory requirement under the 1987 Constitution, which clearly states that “no candidate, who has lost in any election shall, within one year after such election, be appointed to any office in the government or any government-owned or -controlled corporations or in any of their subsidiaries.”

He explained that this provision aims to prevent appointments based on political favor or patronage. “This is so the appointment won’t be used as a reward by the incumbent to those who supported him but lost in the last elections,” Garcia added.

The reminder comes in the wake of President Ferdinand R. Marcos Jr.’s directive for all Cabinet secretaries to submit their courtesy resignations, a move intended to recalibrate his administration. The order has left several top government posts temporarily vacant.
