CONG. POGI WANTS HAZARD PAY FOR PUBLIC PROSECUTORS

Pampanga First District Representative Carmelo “Pogi” Lazatin, Jr. on September 23, 2025, filed House Bill No. 4748, which seeks to grant Hazard Pay to all Public Prosecutors exposed to hazardous situations and performing hazardous duties related to their assigned cases.

Under HB 4748, all public prosecutors performing duties in hazardous situations or exposed to risks by reason of their assigned cases shall be entitled to receive a monthly hazard pay of ₱5,000 in addition to their basic salary. Eligibility shall be certified by the Secretary of Justice or their authorized representative, based on objective criteria to be outlined in the Implementing Rules and Regulations (IRR). The said hazard pay shall be exempt from taxation, in accordance with Section 32(b)(7)(e) of the National Internal Revenue Code of 1997.

It can be recalled that on September 4, Lazatin also filed House Bill No. 4357, which seeks to grant Hazard Pay to all Local Government Employees whose work entails inherent risk or danger to their health and safety, regardless of their employment status.

HB 4357 seeks to grant LGU employees a Hazard Pay equivalent to a minimum of 25% of the employee’s basic monthly salary, and shall be granted monthly alongside the regular salary. Under the proposed bill, LGU employees are qualified to receive Hazard Pay for the performance of duties that expose them to imminent danger, difficulty, and health risks, which are over and above their usual risks in public service. These include physical hazards (dangerous machinery, vehicular traffic, unstable structures, or working at heights); chemical hazards (toxic, corrosive, or flammable substances); biological hazards (infectious agents, human or animal waste, or contaminated environments); environmental hazards (extreme weather conditions, pollution, or prolonged exposure to unsanitary outdoor environments); and situations involving direct threat to life or personal safety.

Employees shall be qualified to receive the said Hazard Pay whether their employment status is permanent, temporary, casual, contractual, contract of service, or job order.
